Man mauled after arguing with 3 women

MANILA, Philippines – The National Bureau of Investigation has filed charges at the Malabon City Prosecutor’s Office against three people – two of them policemen – for allegedly mauling and detaining a man who figured in an argument with three women.
Charged on Dec. 8 with violating Article 124 (arbitrary detention), Article 235 (maltreatment of prisoners), Article 294 (robbery with violence against or intimidation of persons) and Article 265 (less serious physical injuries) of the Revised Penal Code were PO3 Jimmy Duban and PO1 Romy Suatin, both assigned at the Malabon City police station, and Raul John Armas alias “Kumang.”
The case was based on the complaint filed by Teofilo Opalla, 39, a resident of Recomville, Bagumbong in Caloocan City.
An investigation conducted by the NBI Special Task Force showed the incident happened around 2 a.m. last Nov. 2 in an eatery.
According to the NBI, the complainant was drinking with a friend when he decided to go to the toilet. However, he entered the female toilet by mistake and a woman who was inside yelled at him.
The NBI added that when the complainant returned to his table, the woman inside the toilet came out and confronted him, along with two other women.
When he told them that he just made an honest mistake, one of the women threw a glass of water at him, resulting in an argument between the complainant and the three women.
The commotion, however, caught the attention of bystanders and tricycle drivers who mauled the victim and took him to the police station.
The NBI said the complainant was taken to a room at the police station where Duban, without any provocation, punched him in the abdomen and chest before taking him to a hospital to undergo a medical examination.
From the hospital, the complainant was taken back to the police station where he was again beaten up by Duban, Suatin and Armas, the NBI added. The three also took the complainant’s wallet which had P900 before putting him in jail, it said.
When he was released the following day, the complainant said the three men returned his wallet but not his money.
A medical certificate showed that the victim suffered injuries, which prevented him from returning to work, the NBI said.
It added that their investigation showed that the complainant was not formally charged, just detained based on the allegations made by a woman who was not identified.
The accused were summoned to appear before the NBI last Nov. 6 but they just submitted their counter-affidavits to the city prosecutor’s office, the bureau said.
